Terms of Service for Plantsome App

1. Acceptance of Terms

By downloading, installing, or using the Plantsome mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legal agreement between you and Plantsome Retail Ltd. ("Plantsome," "we," "our," or "us"), a company based in Lynden, Washington, United States of America.

Plant care needs can vary based on many factors. We are not responsible for plant health or any damages resulting from following our recommendations.

9.2 Service Availability

We do not guarantee that the App will be available at all times or without interruption. We may modify, suspend, or discontinue the App at any time without notice.

9.3 No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLANTSOME RETAIL INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

You agree to indemnify, defend, and hold harmless Plantsome Retail Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the App or violation of these Terms.

You may stop using the App at any time. If you have an account, you may request deletion by contacting hello@plantsome.com.

We reserve the right to suspend or terminate your access to the App at any time for any reason, including violation of these Terms.

11.3 Effect of Termination

Upon termination, your right to use the App will cease immediately. Provisions that by their nature should survive termination will remain in effect.

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through good faith negotiations. If negotiations fail, disputes shall be submitted to the courts of British Columbia, Canada.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

You may not assign or transfer these Terms or your rights under them. We may assign our rights and obligations without restriction.

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms.
